No! It’s not too late to get money for your small business using the Employee Retention Credit. You can file amended payroll tax returns for 2020 through September 30, 2021 to claim the credit. There is a 3-year statute of limitations on the “Qualifying Wages” for the ERC, which means wages paid in the first quarter of 2020 will no longer be available for the credit after the first quarter of 2023!

To be eligible for the Employee Retention Credit, your business must either have operations that were fully or partially suspended during any calendar quarter in 2020 or any of the first three quarters in 2021 due to COVID-19 orders from an appropriate governmental authority OR have experienced a significant decline in gross receipts during the calendar quarter.
